I am directed by the Custodian to draw your attention to the case of Mr. Wilzer, formerly in the employ of the Chinese Customs Service, and of German nationality.

It appears that Sir John Jordan wrote to the Dutch Minister at Pekin that the Governor of Hong Kong had been authorised to release Mr. Wilzer's money subject to Sir John Jordan being able to vouch for that gentleman's friendly attitude and could confirm his statement that he had been exempted from repatriation. It was stated that Sir John Jordan gave these assurances, and accordingly, on the 12th April 1920, the Custodian of Enemy Property, Hong Kong, wrote to Mr. Wilzer informing him that the Secretary of State for the Colonies had authorised the payment of a lump sum of $5,000 and a monthly sum of $500, provided sufficient funds stood to r. wilzer's account in his books,

Mr. Wilzer's assets consisted solely of 30 shares in the Hong Kong & Shanghai Banking Corporation, of which 16 were on the Hong Kong register, 13 on the London register, and one on the Shanghai register. the Hong Kong and London shares and one Shanghai share were held by the Bank in Hong Kong, according to the order of the Custodian of Hong Kong, and all the dividends which had accrued due were paid in London to the Custodian. was, therefore, impossible for the Hong Kong Custodian to make the payments authorised by the Secretary of State.

Mr. Wilzer appears to have now returned to Hamburg, and he has written to this Department, forwarding to the Custodian copies of the correspondence as per the attached, and requesting that effect should be given to the authority for the release of the shares given by the Hong Kong Custodian. I am to state that the Custodian has in hand dividends amount- ing in all to £795. 19. 8d.

The Custodian will be glad if you will consider this matter and let him know whether, in your opinion, he should give effect to the decision of the Custodian in Hong Kon
